Terms of Service
These Terms govern your use of Vantage Point: Gaming Catalogue and our related websites. By creating an account or using the app, you agree to them. Read alongside our Privacy Policy.
1. About these Terms
These Terms of Service ("Terms") are a binding agreement between you ("you", "your") and Vantage Point Ventures LLC ("Vantage Point", "we", "us", "our"), a Pennsylvania limited liability company. They cover your use of:
- The Vantage Point: Gaming Catalogue mobile app on iOS and Android;
- Our websites at vantage-point.online and any subdomains;
- Any related services, APIs, or features we make available (collectively, the "Service").
If you don't agree to these Terms, don't use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to create an account. By using the Service, you confirm you meet this age requirement and have the legal capacity to enter into this agreement. If you're between 13 and the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who accepts these Terms on your behalf.
3. Your account
- Sign-in. The Service uses passwordless sign-in via a one-time code sent to your email. You're responsible for keeping access to that email account secure.
- Accuracy. Keep your contact information current. If your email becomes inaccessible, you may lose the ability to sign in.
- One account per person. You may not register multiple accounts to evade limits, abuse trial offers, or circumvent suspension.
- Account sharing. Don't share account credentials or sign-in codes with anyone else.
- Notify us of compromise. If you suspect unauthorized access, contact us immediately so we can revoke sessions.
4. What the Service does
Vantage Point is a personal game-tracking app. You add games to your library, organize them into status slots (Front Line, Sightlines, Watchlist, Out of Vision, Archive), rate completed games, and optionally connect with other users ("Scouts") to see what they're playing. We surface gaming news from third-party sources via our "Sector Intelligence" feed and offer an optional AI assistant ("Oracle") that uses an API key you provide.
5. Acceptable use
You agree not to:
- Use the Service in any way that violates applicable law or infringes anyone's rights;
- Harass, threaten, dox, or otherwise harm other users — including through scout connections, custom handles, or feedback you submit;
- Impersonate any person or misrepresent your affiliation with a company or organization;
- Reverse engineer, decompile, or attempt to extract source code from the app, except as expressly permitted by law;
- Scrape, mass-download, or systematically copy data from the Service (including library data, news articles, or scout profiles) by automated means without our written permission;
- Probe, scan, or test the vulnerability of our infrastructure without authorization, or interfere with the operation of the Service (DoS, flooding, etc.);
- Use the Service to distribute malware, spam, or content that is illegal, infringing, or sexually explicit involving minors;
- Resell, sublicense, or commercialize access to the Service without our written permission.
We may suspend or terminate accounts that violate these rules.
6. Your content
Some features let you add or submit content ("Your Content"): library entries (including ratings and notes), feedback messages, custom avatar colors, scout connections, and similar information. You retain ownership of Your Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and transmit Your Content solely as needed to operate the Service for you — for example, syncing your library to your other devices, showing your profile to scouts you've connected with, or processing feedback you've sent us. We don't use Your Content to train AI models, generate ads, or sell to third parties.
You're responsible for ensuring Your Content doesn't infringe others' rights or violate applicable law.
7. Game metadata and third-party content
Game titles, cover artwork, summaries, and other metadata come from third-party sources including IGDB, Steam, and the individual game publishers. They retain all rights to that content. We display it under the API terms of those services and in accordance with fair-use principles, but we make no representations about its accuracy, completeness, or current availability.
The "Sector Intelligence" news feed surfaces headlines and excerpts from third-party publishers (e.g., IGN, Polygon, etc.). We don't endorse those outlets, and articles are linked back to the publisher's site. Editorial responsibility rests with the publisher.
8. Pro subscription and in-app purchases
Subscription
Vantage Point Pro is a premium subscription offered through the Apple App Store (iOS) and Google Play (Android). Two billing cadences are available:
- Monthly: US $1.99, billed at the start of each monthly period.
- Annual: US $17.99, billed at the start of each annual period.
Prices shown are in US dollars for purchases made through the US storefronts; equivalent local-currency pricing applies to other storefronts and is disclosed on the relevant store listing before purchase.
Pro unlocks features above the free tier. The current Pro feature set is disclosed in-app on the Store screen and on the relevant store listing before purchase. We may add features to the Pro tier; we will not remove a feature you paid to access without giving you advance notice and an opportunity to cancel without penalty.
Trial period. New accounts may be offered a Pro trial at sign-up. The trial length and terms are disclosed in-app and on the store listing before you begin the trial. If you do not cancel through the platform store before the trial ends, your subscription auto-renews at the rate disclosed at the time of purchase.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel auto-renewal at any time from your device's account settings (App Store or Google Play). We don't have the ability to cancel store-managed subscriptions on your behalf.
One-time purchases
Cosmetic items (themes, accent colors, and similar) and the Founder's Pin are one-time purchases. Once activated to your account, they remain available as long as your account is active and the underlying service is operational.
Refunds
Refunds are handled by Apple or Google under their respective store policies. We are not party to those transactions and cannot issue refunds directly. We will provide supporting information to the relevant store's support team if requested.
If you reside in the European Union or the United Kingdom, you have a statutory right to withdraw from a subscription purchase within 14 days of the transaction without giving a reason, subject to local consumer-protection law (Directive 2011/83/EU in the EU and the Consumer Contracts Regulations 2013 in the UK). By beginning to use Pro features immediately after purchase, you explicitly consent to the digital content being supplied before the end of the 14-day withdrawal period, and you acknowledge that once supplied, your statutory right of withdrawal no longer applies to content actually delivered.
To exercise refund or withdrawal rights where they apply, contact the platform store (App Store or Google Play) directly using their standard refund-request flow. You may also contact us at support@vantage-point.online and we will assist with documentation where possible.
Nothing in this section affects any non-waivable consumer rights you may have under the law of your country, state, or province of residence.
9. Oracle (optional AI feature)
The Oracle feature is opt-in and uses a Gemini API key you provide yourself from Google AI Studio. Your key stays on your device. We don't proxy, log, or store your Oracle conversations. Your use of Oracle is governed by Google's API and AI service terms in addition to these Terms. We make no representations about the accuracy, safety, or legality of Oracle's outputs — verify anything important.
10. Service availability and changes
We work to keep the Service available but don't promise uninterrupted access. We may modify, suspend, or discontinue features (or the whole Service) at any time. Where reasonable, we'll give advance notice via the app or our website. We're not liable for changes to or discontinuation of the Service.
11. Intellectual property
The Service — including the app's source code, design, branding, "Vantage Point" name and logo, and all original content we produce — is owned by Vantage Point Ventures LLC and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for non-commercial personal use, subject to these Terms.
You may not copy, modify, distribute, sell, or lease any part of the Service except as permitted by these Terms or by applicable law (e.g., the limited rights granted under fair use or fair dealing).
12. Feedback
If you submit feedback, bug reports, or feature suggestions through the in-app feedback form or any other channel, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose (including modifying the Service) without compensation or attribution.
13. Termination
By you
You may stop using the Service at any time. To delete your account and the data tied to it, follow the steps on our Delete Account page. Deletion is permanent.
By us
We may suspend or terminate your account if you violate these Terms, if your account is dormant for an extended period, or if we reasonably believe termination is necessary to protect the Service or other users. Where the issue is fixable and the circumstances allow, we'll give you a chance to remedy it before acting. Termination doesn't entitle you to a refund of pre-paid subscription fees, except where required by law or store policy.
14. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components, or that defects will be corrected.
You use the Service at your own risk. Nothing in the Service constitutes professional, legal, medical, or financial advice.
15. Limitation of liability
To the maximum extent permitted by law, Vantage Point Ventures LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service is limited to the greater of: (a) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred United States dollars (US $100).
Nothing in this section limits or excludes liability for: (i) fraud, gross negligence, or willful misconduct; (ii) death or personal injury caused by our negligence; or (iii) any liability that cannot be lawfully limited or excluded under applicable law, including (where applicable) consumer-protection statutes of your jurisdiction of residence.
Where applicable law does not permit the limitations or exclusions set forth in this section, our liability shall be limited to the greatest extent permitted by that law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Vantage Point Ventures LLC, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Content, or your violation of these Terms.
17. Governing law and dispute resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first
Before initiating any legal action, you agree to contact us at support@vantage-point.online and allow thirty (30) days for a good-faith attempt at informal resolution. We agree to the same obligation in reverse for any dispute we have with you.
Forum and jurisdiction
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the Commonwealth of Pennsylvania. You and Vantage Point Ventures LLC consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.
Consumer-protection carve-out
If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose consumer-protection law grants you the right to bring proceedings in your local courts or to use an out-of-court dispute resolution mechanism, nothing in this section limits that right.
No class actions
To the extent permitted by applicable law, any dispute must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. This clause does not apply where prohibited by law.
18. Changes to these Terms
We may update these Terms as the Service evolves. The "Effective" date at the top of this page reflects the most recent revision. Material changes will be surfaced inside the app or by email before they take effect. By continuing to use the Service after the changes become effective, you agree to the updated Terms. If you don't agree, stop using the Service before the effective date.
19. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service, and supersede any prior agreements on the same subject matter.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor (e.g., in connection with an acquisition or reorganization).
- Force majeure. Neither party is liable for failure to perform due to events beyond reasonable control (natural disasters, war, pandemics, internet outages, etc.).
- Headings. Section headings are for convenience only and don't affect interpretation.
20. Apple App Store additional terms
If you downloaded the app from the Apple App Store, you also acknowledge:
- These Terms are between you and Vantage Point Ventures LLC, not Apple. Apple has no responsibility for the app or its content.
- Apple is not responsible for support or maintenance of the app and has no obligation to provide it.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability, consumer protection, or intellectual property claims (subject to Apple's own EULA for the app).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
